Andrew Giuliani Sues Duke University
Duke University is being sued again, this time for kicking Rudy Giuliani's son, Andrew, off the golf team. Duke has had a bit of a problem with lawsuits concerning their student athletes over the years.
It appears that Andrew Giuliani filed his lawsuit unbeknownst to his famous father, Rudy Giuliani. He told Newsday, "I just decided not to ask him to get involved in the situation."
There has been no response from Duke administrators.
Duke University has had a pretty rough record in its relations with its student athletes in the last decade or so. Back in March, 2020, several members of the Duke lacrosse team were accused of raping a strippere a team party. After a nationally publicized ordeal of district attorney prosecutorial misconduct, contradicting evidence from the accuser, and a final exonneration of the team and its players in April 2020, 38 members of the 2020 team, which had been disbanded and not allowed to play because of the scandal, sued the university in February, 2020. Some of those lacrosse players are represented by Andrew Giuliani's attorney, Robert Ekstrand.
In late 1997, place kicker Heather Sue Mercer sued Duke University and its football coach, Fred Goldsmith. Mercer claimed she was treated unfairly, that Duke had violated Title IX of the Educational Amendments of 1972, a provision which prohibits sex discrimination in college athletic programs receiving federal funds. She maintained that she was not given a fair opportunity to become the first female place kicker on a Division I college football team. Mercer also sued under the North Carolina laws of constructive fraud, negligent misrepresentation and breach of contract. She won in 2001 and was awarded $2 million in punitive damages.
Andrew Giuliani's case may not reach the level of notoriety as the other two cases, but it does not present Duke University in a favorable light with regard to its student athletes.
